General Terms and Conditions

1) Right of withdrawal

In accordance with the provisions of Legislative Decree 185/1999 (Implementation of Directive 97/7/EC on the protection of consumers in distance contracts), the Customer has the right to withdraw from the contract concluded online without any penalty and without specifying the reason, in the manner and under the conditions listed herein: the right of withdrawal is exercised by sending, within the aforementioned term of 10 working days from receipt of the goods, a written notice by registered letter with return receipt addressed to:

The communication may also be sent, within the same term, by fax to the number 39 043967674, provided that it is confirmed by registered letter with acknowledgement of receipt within the following 48 hours. The communication must contain the codes of the products you intend to return and indications on how to reimburse the expenses incurred (money order, bank transfer, etc.) and any bank details. The items must be returned by the customer intact, to the same address used for the registered letter. As soon as we receive the goods and check their integrity, we will credit the cost of the returned articles to the customer.

2) Irrevocability of the order

The purchase order for products placed by the Purchaser is irrevocable for the Purchaser, subject to the right of withdrawal provided for in point 1).

3) Prices and delivery

Prices are understood to include VAT and for goods returned ex-works to the address specified by the purchaser at the time of purchase, including standard packaging and excluding special packaging and any ancillary costs, unless otherwise specified in writing upon acceptance of the order. The agreed prices are intended as referring to these general conditions of sale. Zeniscultori.com reserves the right to change the price list without notice.

4) Terms and methods of acceptance and delivery

Zeniscultori.com shall not be held liable for non-acceptance of an order or for non-delivery or delayed delivery of the products ordered, since both acceptance and execution of the order specifically depend on the availability of the products ordered as well as the absence of circumstances which may affect their availability or their timely delivery. This includes, by way of example, in addition to force majeure and fortuitous events, circumstances such as strikes, riots, labour unrest, lack of raw materials, which may prevent or delay the manufacture or delivery of the products. The Purchaser undertakes to exonerate Zeniscultori.com from all liability, expressly waiving any claim for damages for non-acceptance or delayed acceptance of the order, or for non-delivery or delayed delivery of the products subject of an order already accepted. Delivery of the products is understood to have taken place when the package is delivered to the addressee or directly collected from our premises.

5) Buyer’s complaints

Zeniscultori.com carefully checks the products at the time of shipment, so any damage or shortcomings must be notified to the Carrier when the goods are collected. Any defects found which are not due to transport shall be notified in writing to Zeniscultori.com within 8 days of their discovery.
Zeniscultori.com shall examine the complaint within a reasonable time and, if it proves to be well founded, shall send the missing or damaged parts to the Purchaser.

6) Warranty

Zeniscultori.com guarantees the products for 12 months from the date of shipment, provided that they are stored and used in accordance with the specifications of the product itself. The guarantee is limited to the free replacement of those parts which, in the opinion of Zeniscultori.com, prove to be defective, with the exception of parts of normal wear and tear and components, assemblies and accessories guaranteed directly by third-party manufacturers. The cost of transport of products or parts under warranty shall be borne by the Purchaser. Without the express written authorisation of
Zeniscultori.com, the Purchaser may not carry out any disassembly, modifications or repairs except at his own expense and risk, thereby terminating all Zeniscultori.com guarantees. Beyond the limits of this guarantee, the Purchaser may not request termination of the contract, suspension of payments or any compensation for any damages.

7) Product improvements and technical updates

Zeniscultori.com reserves the right to process orders placed by the Buyer with products to which any changes have been made in order to improve their performance, technology or appearance.
Zeniscultori.com shall not be obliged to apply the aforementioned modifications to products delivered previously in favour of the Buyer.

8) Returns

Any returns, beyond the period envisaged by the Right of Withdrawal referred to in point 1), must be authorised in writing by Zeniscultori.com and delivered, free of charge, to:

9) Technical data of the products

Measurements, weights and technical data of products as illustrated in Zeniscultori.com brochures or catalogues are to be considered indicative and not binding in terms of detailed specifications.

10) Disputes and jurisdiction

The purchase order made to Zeniscultori.com is governed by the principle of “solve et repete” pursuant to art. 1462 C. C. The applicable law is that of Italian Law. The place of jurisdiction is Trento (Italy).

11) Privacy

Zeniscultori.com processes the personal data of its customers in compliance with the provisions of Legislative Decree 196/2003. Personal data are collected for the purpose of the mere execution of the contract. As provided for by the regulations, the person concerned may obtain confirmation of the existence or non-existence of his/her personal data and that these are communicated to him/her in a clear form. The data subject may also request the deletion, amendment, transformation into an anonymous form or blocking of the processed data for legitimate reasons.
